1. Introduction
Welcome to Wild Shark Fishing! These terms and conditions ("Terms", "Agreement") are an agreement between Wild Sweet Sharks ("App Operator", "us", "we" or "our") and you ("User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the Wild Shark Fishing mobile application ("App") and any of its products or services (collectively, "Mobile Application" or "Services").
2. Acceptance of Terms
By accessing and using the App, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you should not use the App.
3. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after such modifications will constitute your acknowledgment of the modified Terms and your agreement to abide and be bound by the modified Terms.
4. User Accounts
To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and agree not to disclose your password to any third party. You agree to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.
5. Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates any applicable federal, state, local, or international law or regulation;
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App, or which, as determined by us, may harm us or users of the App or expose them to liability;
- Use the App in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the App;
- Use any robot, spider, or other automatic device, process, or means to access the App for any purpose, including monitoring or copying any of the material on the App;
- Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful;
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App.
6. Intellectual Property Rights
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Wild Sweet Sharks, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7. Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms. If you wish to terminate your account, you may simply discontinue using the App.
8. Limitation of Liability
In no event shall Wild Sweet Sharks, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Your Country], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our App and supersede and replace any prior agreements we might have had between us regarding the App.
10. Data Sharing
We value your privacy and are committed to protecting your personal information. We do not sell, trade, or otherwise transfer your personal information to outside parties. All data collected is used solely for the purpose of improving your experience within our App.
11. Changes to This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
